Islamabad High Court (IHC) while ordering to remove the name of Azam Khan former principal secretary of PTI chairman Imran Khan from stop list has allowed him to go abroad.
The petition against placing the name of Azam Khan in stop list came up for hearing before a single bench of IHC led by Chief Justice (CJ) Athar Minallah here Wednesday.
Azam Wadood, counsel for Azam Khan argued whenever we will be called by Public Accounts (PAC) we are ready to appear before it.
The court inquired during the hearing of the case under what law this name was included in stop list.
The court remarked PAC has a specific role.
The counsel for the petitioner told the court Azam Khan was asked to appear with record. How he can he produce record when he remains no more principal secretary.
The court remarked NAB will have the record regarding this case.
The counsel told the court we were called in Tayyaba Gul case that he should come to PM office. Whenever he is called he will appear on expiry of Ex-Pakistan leave.
Assistant Attorney General (AAG) Usman Warraich told the court please justify what is PNIL stop list.
The court remarked PNIL has no legal status. There is no such reason that name is included in PNIL.
The counsel for the petitioner told the court Azam Khan departure is on September 08 and his arrival is before September 25.He can appear before PAC before this.
The court remarked if the PAC summons Azam Khan before September 8 then he should appear. No restriction can be imposed on the freedom of Azam Khan.
The counsel for Azam Khan told the court has he to be humiliated merely by calling him or something has to be asked really from him.
The court remarked Azam Khan should go if he was summoned in parliament. Who else were summoned in Tayyaba Gul issue case. Did the other people appear.
AAG said PAC asked to place name in ECL in Malam Jabba case.
The court remarked if Azam Khan was summoned in Tayyaba Gul case then tell us whether all other relevant persons were summoned or otherwise. Tell us were the directives issued to include name of other persons in PNIL.
The court allowed Azam Khan to go abroad after hearing the arguments of the lawyers besides ordering to remove his name from stop list.
The court directed that if PAC summons him then Azam Khan should appear.
