The Supreme Court (SC) bench hearing suo motu notice on murder of family members of Nayab Imrani stands dissolved as Justice Athar Minallah has recused from hearing the case.

A 3-member bench of SC presided over by Chief Justice (CJ) Umar Ata Bandial took up the case for hearing Tuesday.

The CJP remarked now property matter is a civil case. What can we do. We were only to make possible access to justice.

The CJP while addressing the counsel for Nayab Imrani remarked is SC monitoring the trial running in subordinate court.

The counsel for Nayab Imrani said the issue of trial has been resolved which is running as per law. The issue of evidence in criminal trial also stands resolved. Now the matter of only implementation of SC November 9, 2018 order is left.

Additional advocate general Balochistan told the court all the property has been given to Nayab Imrani.

Justice Athar Minallah remarked how can we hear the matter of inheritance directly. Now this matter is between the parties concerned. The court has to see the rights of all. Has the petitioner no trust on the subordinate court.

Justice Athar Minallah while recusing from hearing the case separated him from the bench.

The hearing of the case was adjourned till December.
