ISLAMABAD, Dec 09 (Online): Supreme Court (SC)has questioned ongoing process of making arrests of its own choice by NAB’
The court has ordered NAB to file detailed report on the procedure of making arrests in line with NAB ordinance till Monday.
The court gave these orders during the course of hearing of bail plea of Dr Dinshaw and Jamil Baloch accused in fake bank accounts case.
The case came up for hearing before a 3-member bench of SC presided over by Justice Umar Ata Bandial Thursday.
Rashid Rizvi, counsel for Dr Dinshaw argued “my client is in jail since the last 20 months. My client was arrested in the reference while the others are roaming free. Zain Malik is CEO of Glaxi construction. My client purchased the plot in legal way. My client belongs to minority which is weak. There are 86 witnesses in the reference. If the case continues to run this way then my client will remain in jail for more three years.
Khawaja Haris, counsel for Liaqat Qaim Khawani told the court Bahria Town is the major beneficiary in this matter. The entire money which was spent on construction of Bahria Icon Tower was shifted from accounts of Bahria town.
Asghar Haider Prosecutor General NAB told the court that the prime accused persons in the case have been arrested. Plea bargain is major hurdle in arresting the accused. NAB hands are tied due to applications of plea bargains.6 plea bargains applications of Bahria Town have been approved while 7 are pending. NAB makes arrests on merit. Now NAB procedure has been changed. First of all call up notice is issued to accused. Reply is sought from the accused. Later proceeding starts. Those who have not been arrested may have perhaps filed plea bargain application. All the facts will be mentioned in detailed report.
Justice Mazahir Ali Naqvi remarked what is logic in arresting some accused and not arresting the other accused in one case. As to why 4 among 25 accused were arrested. Dr Dinshaw is in jail since the last 20 months. Why the charge has not been framed against him so far. Tell us what is procedure for arresting the accused persons.
Justice Umar Ata Bandial remarked we are concerned as to why NAB is not arresting some accused persons.
Justice Sajjad Ali Shah remarked at some places wings of NAB are burnt. NAB sees nothing if it closes its eyes and ears.
The court while ordering NAB to file detailed report on procedure of making arrests in line with NAB ordinance adjourned the hearing of the case till next week.
