ISLAMABAD, August 23 (Online): Supreme Court (SC) has stopped implementation of suo motu notice taken by Justice Qazi Faez Isa on the matter of harassment of the journalists.
During the hearing of the case the SC raised the question can any judge other than Chief Justice of Pakistan (CJP) take suo motu notice. This issue will be seen. We want to hear the real stake holders for determination of powers for taking suo motu notice. Attorney General of Pakistan, President Supreme Court Bar Association and chairman Pakistan Bar Council should assist the court in this matter.
A five members larger bench of SC presided over by the acting CJP Umar Ata Bandial took up for hearing matter related to the determination of powers for taking suo motu notice.
The acting CJP Umar Ata Bandial remarked the journalists’ case is sensitive. He is happy that they resorted to court. It is matter of regret that the journalists did not rely upon the judiciary as institution.
SC Registrar office informed the acting CJP in writing. Registrar office told that what procedure has been adopted is not in conformity with judicial procedure. There is formal procedure for filing case in the court and fixing it for hearing.
During the hearing of the case president SC Bar Latif Afridi raised the question there is impression that the judiciary is divided.
Justice Umar Ata Bandial while addressing Latif Afridi remarked there is no division in the judiciary. The opinion of judges is different on different points.
The court while issuing notices to attorney general of Pakistan, president SC Bar Association and vice chairman Pakistan Bar Council summoned them on next hearing for assistance.
The court adjourned the hearing of the case till August 25, 2021.
The court maintained that the problems facing the journalists will not be reviewed in this proceeding. We want proceedings on the petition of the journalists in transparent manner. We don’t want such proceeding which is surprise for any one.
