IHC accepts EC plea seeking time to file reply in connection with LB polls in IBD

Islamabad High Court (IHC) has accepted Election Commission (EC) plea for giving it more time to file reply in connection with Local Bodies (LB) polls in Islamabad.

The court has sought on June 22 its clear stance from EC under government notification.

The case came up for hearing before a single bench of IHC led by Chief Justice (CJ) Athar Minallah Monday.

EC told the court IHC had nullified ordinance related to LB polls and the court had announced decision on holding the election under old laws. Now number of union councils has been increased. Had the number of union councils not been increased then our preparations for election were complete. EC has issued schedule for LB polls.

Advocate General (AG) Islamabad, Jahangir Jadoon told the court we don’t want delay in the election.

The court inquired now new delimitation of constituencies will have to be carried out.

AG said delimitation of constituencies will be made.

The court inquired how much time will be required for delimitation of constituencies.

EC told the court at least two months will be required for delimitation of constituencies.

The court inquired have you carried out delimitation of constituencies of 100 union councils.
Qazi Adil advocate told the court EC has carried out delimitation of constituencies of 100 union councils in January.

The AG told the court there is problem of delimitation of constituencies only of one union council.

The court remarked you have carried out delimitation of constituencies of 100 union councils. Now the schedule can be issued again.

The court inquired when the polls schedule has been issued then will the EC not hold election. Federal government issued notification of election. Now where this notification will stand. EC already knew about 100 union councils.

The defence counsel told the court government has completed 100 union councils. Now 50 union councils are not existing. Then how will they hold elections therein.

Deputy Attorney General (DAG) told the court government has withdrawn notification of 50 union councils.

The court remarked EC is going to hold election on what notification.

EC told the court we are going to hold election on the basis of notification of 50 union councils.

The court remarked these union councils are not existing. The notification about 50 union councils has been withdrawn in May 2021.

The EC authorities said EC is bound to hold election as per federal government notification. Time be given. We satisfy the court on it.

The court while accepting EC plea for giving it more time to file reply adjourned the hearing of the case till June 22.
